Intellectual Property Rights as Fiduciary Collateral in the Indonesian Banking System

Abstract
This study analyzes the utilization of Intellectual Property Rights as an object of fiduciary guarantee in the national financing system. This normative juridical research uses a statutory and conceptual approach to examine the legal position of IPR, the fiduciary guarantee framework, valuation mechanisms, and implementation barriers in IPR-based financing. The results of the study indicate that IPR has a strong legal position as intangible property that can be used as an object of fiduciary guarantee. The fiduciary guarantee framework has provided protection for creditors, but its implementation faces procedural obstacles and certainty of execution. The IPR valuation mechanism requires methodological standardization and the strengthening of the role of appraisal institutions. Implementation barriers include the absence of standard procedures, the absence of value benchmarks, the lack of clarity in execution mechanisms, and the absence of a secondary market. This study recommends regulatory strengthening, the establishment of a specialized valuation institution, the development of international valuation standards, and synergy among stakeholders to create a credible and sustainable IPR-based financing ecosystem.
