Police Clearance Certificate Policies and the Protection of Former Prisoners against Employment Discrimination
Main Article Content
Abstract
Police clearance certificates are frequently used in employment recruitment, raising concerns about equal employment opportunities for former prisoners. This study examines the implications of Police Clearance Certificate (SKCK) requirements for employment access and human rights protection, as well as policy alternatives supporting social reintegration. Using normative legal research, the study employs statutory and conceptual approaches based on legal regulations and relevant literature. The analysis indicates that indiscriminate use of criminal records in recruitment may reinforce social stigma and restrict employment opportunities for individuals who have completed their sentences. Such restrictions require careful examination against principles of equality, non-discrimination, and the rehabilitative objectives of correctional policies. Policy reform may include job-related background assessments, vocational certification, employment assistance, and cooperation between correctional institutions and employers. The study concludes that proportional recruitment requirements and sustained reintegration support are necessary to balance legitimate workplace security concerns with fair employment opportunities for former prisoners.
