Restorative Justice Approaches in Addressing Children in Conflict with the Law: A Normative Analysis
Main Article Content
Abstract
This study analyzes the implementation of restorative justice in handling children in conflict with the law based on Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. Using a normative juridical research method with statutory and conceptual approaches, this study examines the effectiveness of the diversion mechanism as a transfer of child case resolution from formal justice to out-of-court processes. The results of the study indicate that restorative justice through diversion has successfully shifted the punitive paradigm toward a constructive rehabilitative approach by prioritizing relationship restoration, the best interests of the child, and the active participation of the perpetrator, victim, family, and community. However, its implementation faces challenges in the form of law enforcement officials' commitment, compliance with procedural deadlines, and social stigma against child perpetrators. This study recommends capacity building for human resources, enhancement of child-friendly mediation facilities, and socialization of restorative justice values to optimize child protection and prevent the recurrence of criminal offenses.
