Problems of Upgrading Building Use Rights to Ownership Rights for Shop Houses and Office Houses in the National Land Law System

Abstract
The rapid development of land use triggers the transition of property functions from residential allocation to commercial areas. This shifting trend phenomenon demands a guarantee of certainty regarding land rights status for owners. This writing aims to examine the juridical basis for the utilization of shophouses, as well as the procedures for upgrading their ownership status. This paper analyzes the position of building approval as an alternative requirement along with the urgency of harmonizing legal norms. This normative legal research uses a conceptual approach and formal policy instruments. All literature is analyzed through a qualitative method. The results of the study indicate that upgrading land status requires administrative completeness. The use of optional phrases related to building feasibility triggers interpretive ambiguity and vertical regulatory norm conflicts. This conflict has the potential to neglect the urban area safety supervision system. The implication of the findings obligates policy makers to carry out comprehensive synchronization so that the physical feasibility of buildings is absolutely fulfilled by the public. Such alignment is guaranteed to prevent bureaucratic disputes while securing the investment climate. The research recommends regulatory evaluation and vertical harmonization to align ministerial regulations with higher laws and regulations in order to create a consistent national land legal system and protect public interests.
