Abstract

This study examines the structure of legal relationships and the responsibilities of parties in healthcare services, the role of professional institutions in disciplinary enforcement, the evidentiary system utilizing recommendations from professional institutions, and the application of mediation as the primary approach to medical dispute resolution. Employing a normative approach through library research, this study analyzes the available legal mechanisms and the interactions among them. The findings indicate that healthcare services form a complex network of legal relationships that requires a comprehensive understanding to determine responsibilities proportionally. Professional institutions play a central role in assessing disciplinary violations and providing recommendations that serve as a reference for evidence. Mediation offers an efficient and humane restorative approach as an initial step before pursuing formal legal avenues. The balance of these various legal mechanisms supports the realization of justice and legal certainty for all parties.
